The terms that apply when you use our website or work with DM Studio India.
Effective date: 14 October 2026 · Last updated: 14 October 2026
1. Acceptance of these terms
These Terms & Conditions govern your use of dmstudioindia.com and the services offered by DM Studio India, Bengaluru, Karnataka, India (“DM Studio India”, “we”, “us”). By using this website or engaging our services, you agree to these terms. If you do not agree, please do not use the website.
2. Our services
We provide digital marketing, branding and creative, social media, website design and development, software development, AI solutions and ERP solutions. Information on this website describes our services in general terms. The exact scope, deliverables, timelines and fees for any project are set out in a written proposal, quotation, statement of work or agreement (“Agreement”). If anything in an Agreement conflicts with these terms, the Agreement prevails.
3. Quotations and engagement
- Quotations are valid for the period stated on them, or 30 days if no period is stated.
- A project starts once you accept the proposal in writing (including by email) and pay any advance stated in it.
- Work outside the agreed scope is treated as a change request and may be quoted separately.
4. Fees and payment
- Fees, payment milestones and taxes are as stated in the Agreement. Applicable GST is charged in addition unless stated otherwise.
- Invoices are payable within the period stated on them. We may pause work on overdue accounts.
- Advertising spend on platforms such as Google, Meta and LinkedIn is separate from our fees and is paid by you to the platform, unless agreed otherwise in writing.
- Third-party costs such as domains, hosting, software licences, stock images, plugins and APIs are payable by you unless included in the quote.
5. Your responsibilities
- Provide accurate information, content, approvals and access in good time. Delays in these may move project timelines.
- Make sure any content, logos, images or data you give us are yours to use, and do not infringe anyone else's rights.
- Review deliverables and give feedback within the agreed review period.
- Keep login credentials you receive from us secure.
6. Intellectual property
- On receipt of full payment, ownership of the final deliverables created specifically for you (such as final logo files, designs, website content and custom source code) transfers to you, unless the Agreement says otherwise.
- We keep ownership of our pre-existing tools, frameworks, templates, code libraries and know-how. Where these are part of a deliverable, you receive a licence to use them as part of that deliverable.
- Concepts, drafts and options you did not select remain our property.
- Third-party materials (fonts, stock images, plugins, open-source software) are subject to their own licences.
- Unless you ask us not to, we may show completed work and your name or logo in our portfolio and marketing.
7. Results and performance
We work to deliver measurable outcomes, but rankings, traffic, leads, sales and advertising performance depend on factors outside our control, including search engine and platform algorithms, competition and market conditions. We do not guarantee specific rankings, results or returns unless expressly stated in the Agreement.
8. AI-powered solutions
AI solutions may produce outputs that are inaccurate or incomplete. We design AI features with appropriate checks, but you are responsible for reviewing AI outputs before relying on them for important decisions, and for using AI features in line with applicable law.
9. Confidentiality
Each party will keep confidential any non-public business information received from the other, and use it only for the project. This does not apply to information that is public, already known, or required to be disclosed by law.
10. Hosting, maintenance and third-party platforms
Unless covered by a maintenance plan, we are not responsible for issues after handover caused by hosting providers, third-party plugins, platform changes, software updates or changes made by you or others. Accounts for domains, hosting, ad platforms and social media should be registered in your name.
11. Cancellation and refunds
- Either party may end a project by written notice as set out in the Agreement.
- If a project is cancelled, you pay for work completed and costs incurred up to the cancellation date.
- Advance payments cover work scheduled and started, and are non-refundable once work has begun, unless the Agreement states otherwise.
- Monthly retainers may be ended with 30 days' written notice unless the Agreement states a different period.
12. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, including loss of profit, business, data or goodwill. Our total liability for any claim relating to a project is limited to the fees you paid us for that project in the three months before the claim arose.
